Right for protection of personal data
The right for protection of personal data, as a fundamental right of the man and the citizen, is guaranteed by the Constitution of The Republic of Macedonia, which guarantees the security and confidentiality of personal data.
Protection of personal data processing in Central cooperative bank Plc Skopje
Central cooperative bank Plc Skopje (further on in this document referred to as – The Bank), within her scope of operations and in order to perform customer services, performs collection, storage and processing of personal data.
In terms of protection of personal data processing, The Bank is a Controller of personal data and The Client is a Subject of personal data.
Rights of the Subject of personal data
Awareness of the subject of personal data
When the data are collected from the Subject of personal data, he must be aware of:
- the identity of the controller and his representative in the Republic of Macedonia, if there is one;
- the purposes of the processing;
- the users or categories of users of the personal data;
- the obligation of providing answers to questions;
- the possible consequences if there is no answer;
- having the right to access and correct his data.
Request of information by the Subject
The personal data subject may request from the Bank to inform him for the following:
- whether processing of his personal data is performed;
- for the purposes and the legal basis of the processing of personal data and the users or the categories of users, to whom personal data are revealed;
- for the personal data related with the subject of personal data and the source of data and
- for the logic of automated processing, in the case of a decision based on the automatic processing, which affects the subject of personal data.
For this purpose, the Bank has a special exemplar, Application for delivery of the information for processing of personal data.
The personal data subject may submit the Application in any branch office or affiliate of the Bank.
The Bank is obligated to respond to the personal data subject from paragraph 1 of this Article, within 15 days of receiving the request.
When the Bank has responded to the personal data subject from paragraph 1 of this Article, there is no other obligation to respond again to the same or a similar request of that subject, if meanwhile there is no change in his personal data, unless six months has gone by from the day when the previous application was delivered to the new application.
Termination of the personal data processing
The personal data Subject has the right at any time, free of charge and by using simple tools, to withdraw the consent for processing of his personal data for direct marketing purposes.
For this purpose, the Bank has a special exemplar, Application for termination of the personal data processing.
The personal data subject may submit the Application in any branch office or affiliate of the Bank.
Copy of identity card
Making copies of identity cards is regulated by The Law on the Prevention of Money Laundering and other criminal proceeds and financing of terrorism.
On request of the owner of the ID card the controller, or the Handler, is obligated to issue a certificate for making a copy of the identity card, which shall indicate the purpose for which the copy is made and its storage term.
Video surveillance
The Bank performs video surveillance only of the space that is sufficient to fulfill the purpose for which the same is placed, as the following:
- part of the corridor at the entrance of the facilities of The Bank;
- the interior space of the Bank’s facilities, where official activities take place;
- the corridor in front of and around the ATMs
In all of the premises of the Bank, where video surveillance is performed, there is a notification highlighted, in form of a sticker at the entrance to the premises.
The notification contains information:
- That video surveillance is performed;
- Who performs the video surveillance;
- The way in which information can be obtained, where and for how long the footages from the video surveillance system are stored.
The Bank performs video surveillance only of the space that is sufficient to fulfill the purpose for which the same is placed, as the following:
- part of the corridor at the entrance of the facilities of The Bank;
- the interior space of the Bank’s facilities, where official activities take place;
- the corridor in front of and around the ATMs
In order to file an appropriate complaint, the personal data subject has to prove that he was inflicted with a material or immaterial damage and that it occurred as a result of violations of the LPDP (Law on Personal Data Protection).
